Terms of use
Last updated
Butterfly helps organisations create interactive Stories, deliver learning experiences and understand the results. These terms explain the responsibilities that come with using the platform.
They apply alongside your organisation’s service agreement. Specific commercial and data processing terms are set out in that agreement, with your rights under applicable EU and national law preserved.
1. About these terms
These terms explain the use of Butterfly Interactive, a platform for creating and delivering interactive Stories and learning experiences. The provider is Butterfly Interactive ApS, CVR 46573862, Denmark.
The platform serves organisations and their editors, learners and stakeholders. If you use it on behalf of an organisation, you must have the authority and permissions needed for your actions.
Your organisation may have a separate written agreement covering the service, fees, support, data processing and other commercial arrangements. That agreement takes precedence where it conflicts with these general terms. These terms do not reduce rights that cannot be excluded under applicable EU or national law.
2. Accounts and access
Provide accurate account information, protect your sign-in details and use only the access granted to you. Let us or your organisation's administrator know if you suspect someone is using your account without permission.
Organisation administrators and project owners manage access to their content and learning records. A link to a Story or Learning Session gives access to that experience; it does not give permission to edit the project or access other participants' information.
You must not attempt to bypass access controls, impersonate another user or use another organisation's content or data without permission.
3. Using Butterfly responsibly
Use the platform lawfully and respect the people taking part in your experiences.
- Do not upload unlawful material, malicious code or content that infringes another person's rights.
- Do not disrupt the platform, probe accounts without authorisation or attempt to extract data you are not permitted to access.
- Do not copy, resell or redistribute the platform or another party's materials beyond your permission or applicable legal rights.
- Do not use learning records to harass participants or make unsupported claims about their beliefs, health or personality.
4. Organisation responsibilities
The organisation providing an experience is responsible for the content it publishes, the audience it invites, its access settings and the purposes for which it uses learning information. Editors should review their Stories before publishing and check that content is appropriate for the intended learners.
The organisation must provide the information required for its collection and use of participants' data. This includes explaining whether participation is required, whether individual records are available to organisers and how the results will be used.
Experiences involving children, sensitive personal data or regulated training may need additional safeguards. Any specific requirements for hosting, retention, confidentiality or security must be addressed in the relevant agreement and setup.
5. Content and intellectual property
Butterfly and its licensors retain their rights in the platform, software and underlying technology. Access to the service does not transfer ownership of those materials.
You or the relevant rights holder retain ownership of the content you provide. You must have the rights and permissions required for us to host, process and deliver it as part of the agreed service. Ownership and permitted use of commissioned content, templates or other project materials are governed by the applicable agreement.
A published Story is a snapshot of the project at publication. Editing a draft does not automatically change an existing published version. The organisation is responsible for managing which versions and links remain available to learners.
6. Privacy and learning data
Our Privacy policy explains the different roles of Butterfly and the organisation providing an experience. Where we process learner information on an organisation's behalf, the applicable data processing agreement sets out the instructions and responsibilities.
Optional Story analytics requires a separate choice. Accepting these terms does not give consent to analytics. Declining analytics does not prevent a learner from experiencing a published Story.
Account progress and Learning Session records are separate from optional Story analytics. The responsible organisation must explain the basis for collecting and using those records.
7. Service availability and changes
We maintain and develop the platform, including changes needed for security, reliability and legal requirements. Interruptions may occur because of maintenance, network conditions or services supplied by others.
Availability commitments, support arrangements and any notice requirements for changes are set out in the applicable service agreement. That agreement also governs subscription periods, fees, renewal, cancellation and return or deletion of customer data.
Access may need to be restricted to address misuse, a security incident or a legal requirement. Any such action is subject to the applicable agreement and law. Contact us if you believe your access has been restricted in error.
8. Third-party services
The platform uses providers for functions such as hosting, authentication, storage and video delivery. Some experiences may also link to external websites or content chosen by their editors.
External services may have their own terms and privacy information. The organisation should check those services before including them in a Story. Our use of providers to deliver Butterfly is described in the Privacy policy.
9. Learning outcomes and liability
Butterfly provides tools for learning, reflection and training. A fictional scenario, quiz score or analytics result does not replace professional judgement or establish that a person is qualified for an operational role.
Organisations should assess the suitability of their training and interpret results in context. Learning statistics should not be the sole basis for significant decisions about a person.
Any agreed allocation or limitation of liability is set out in the applicable contract and is subject to mandatory law. Nothing in these terms excludes liability or rights where doing so would be unlawful.
10. Questions and updates
Contact Butterfly Interactive ApS through our Contact page for questions about your service or these terms. For personal-data questions, email privacy@butterflyinteractive.com.
We may update these terms as the service develops. We will identify the latest revision on this page. Changes to an organisation's agreement follow the notice and amendment provisions in that agreement.
Any governing-law or dispute-resolution provisions in your agreement apply subject to mandatory EU and national law, including any statutory consumer rights.
